This Agreement constitutes an official and public offer by the Seller to enter into a sales contract for goods presented on the website shop.theukrainians.org. This Agreement is public, meaning that under Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity or sole proprietor) and cannot give preference to one buyer over another.<\/p>\n\n\n\n
By concluding this Agreement, the Buyer fully accepts all terms regarding order placement, payment, delivery, returns, liability for fraudulent orders and all other provisions. The Agreement is considered concluded once the Buyer clicks the \u201cConfirm Order\u201d button on the Checkout page and receives an electronic confirmation from the Seller.<\/p>\n\n\n\n
1.1. Public Offer (hereinafter \u201cOffer\u201d) \u2014 a public proposal by the Seller, addressed to an unlimited number of persons, to enter into a distance sales contract (hereinafter \u201cAgreement\u201d) under the terms set out in this Offer.<\/p>\n\n\n\n
1.2. Goods \u2014 any item selected by the Buyer on the website of the online store and added to the Shopping Cart, or any item purchased remotely from the Seller.<\/p>\n\n\n\n
1.3. Online Store \u2014 the Seller\u2019s website at shop.theukrainians.org, created for concluding retail sales agreements online.<\/p>\n\n\n\n
1.4. Buyer \u2014 a legally capable individual aged 18 or older who receives information from the Seller and places an order for personal (non-business) use or a legal entity\/sole proprietor.<\/p>\n\n\n\n
1.5. Seller \u2014 Sole Proprietor (\u0424\u041e\u041f) Paplauskaite Mariia Oleksandrivna<\/em>, TIN 3240215807, registered under Ukrainian law, address: Ukraine, 02081, Kyiv, Prychalna Street 14, Apt. 53.<\/p>\n\n\n\n 1.6. Acceptance \u2014 full and unconditional agreement of the Buyer to all terms of this Offer (confirmed by clicking \u201cConfirm Order\u201d).<\/p>\n\n\n\n 1.7. Documents (Appendices) to the Offer \u2014 separate documents that form an integral part of this Offer:<\/p>\n\n\n\n 2.1. The Seller agrees to transfer ownership of the selected Goods to the Buyer, and the Buyer agrees to pay for and accept the Goods under the terms of this Agreement.<\/p>\n\n\n\n 2.2. The Agreement is considered concluded on the date the Buyer fills out the order form on the Online Store and receives an electronic confirmation from the Seller. Upon request, the Agreement may also be executed in writing.<\/p>\n\n\n\n 3.1. The Buyer independently places an order through the online form on the website or, if needed, submits the order request by email or phone specified in the \u201cContacts\u201d section.<\/p>\n\n\n\n 3.2. The Seller may refuse to process an order if the information provided is incomplete or raises doubts regarding its accuracy.<\/p>\n\n\n\n 3.3. When placing an order, the Buyer must provide:<\/p>\n\n\n\n 3.4. By placing an order, the Buyer confirms that they have read this Agreement as well as all accompanying Documents (\u201cDelivery and Payment,\u201d \u201cReturns and Exchanges,\u201d \u201cPrivacy Policy\u201d).<\/p>\n\n\n\n 4.1. Full details regarding payment methods and procedures are set out in the document \u201cDelivery and Payment,\u201d which forms an integral part of this Offer and applies to all Buyer orders.<\/p>\n\n\n\n 5.1. All delivery terms (timeframes, fees, special conditions) are defined in the document \u201cDelivery and Payment\u201d, which is an integral part of this Offer and has equal legal force.<\/p>\n\n\n\n 6.1. Complete rules for returns and exchanges \u2014 including timeframes, conditions, procedures, and return address \u2014 are provided in the separate document \u201cReturns and Exchanges,\u201d which forms an integral part of this Offer.<\/p>\n\n\n\n 7.1. The Seller processes the Buyer\u2019s personal data in accordance with Ukrainian legislation (the Law \u201cOn Personal Data Protection\u201d and Resolution of the Cabinet of Ministers No. 835 of 17.09.2014). All details regarding what data is collected, for what purpose, how long it is stored, and how it is protected, are set out in the \u201cPrivacy Policy,\u201d which forms an integral part of this Offer.<\/p>\n\n\n\n 7.2. Mandatory Acknowledgment: Familiarization with the Privacy Policy is required to conclude the Agreement. By clicking \u201cConfirm Order,\u201d the Buyer confirms they have read and understood this document.<\/p>\n\n\n\n 8.1. The Seller is liable, under Ukrainian law, for failure to properly fulfill the terms of the Agreement.<\/p>\n\n\n\n 8.2. If the Buyer\u2019s personal data is lost or disclosed through the Seller\u2019s fault, the Buyer may claim compensation as provided under the Civil Code of Ukraine.<\/p>\n\n\n\n 8.3. The Buyer is responsible for the accuracy of the information provided when placing an order.<\/p>\n\n\n\n 9.1. Neither party is liable for partial or complete non-performance of obligations caused by force majeure circumstances, including natural disasters, military actions, epidemics or technological accidents.<\/p>\n\n\n\n 9.2. The affected party must promptly notify the other and provide supporting documents.<\/p>\n\n\n\n 10.1. All disputes arising from or related to this Agreement shall be resolved through negotiations.<\/p>\n\n\n\n 10.2. If resolution through negotiation is impossible, disputes shall be settled in court at the Seller\u2019s location (Kyiv).<\/p>\n\n\n\n 11.1. The Seller reserves the right to amend this Offer. The updated Offer becomes effective immediately upon publication on the Online Store website.<\/p>\n\n\n\n Sole Proprietor (\u0424\u041e\u041f) Paplauskaite Mariia Oleksandrivna 1.1. This document is an integral part of the Seller\u2019s Public Offer Agreement and regulates the procedure, conditions, and timeframes for returning or exchanging goods purchased from shop.theukrainians.org.<\/p>\n\n\n\n 1.2. Familiarization with this document is required to conclude the Agreement. Clicking \u201cConfirm Order\u201d means the Buyer agrees to the return and exchange terms.<\/p>\n\n\n\n 1.3. Definitions:<\/p>\n\n\n\n 2.1. Under Article 9 of the Law of Ukraine \u201cOn Consumer Protection,\u201d the Buyer may return goods of proper quality within 14 calendar days from receipt (excluding the date of purchase), provided that:<\/p>\n\n\n\n 2.2. Return shipping costs for goods of proper quality are paid by the Buyer.<\/p>\n\n\n\n 2.3. The Seller refunds the cost of the goods only (excluding delivery fees), unless the parties agree otherwise.<\/p>\n\n\n\n 2.4. Under the Cabinet of Ministers Resolution No. 172 (19.03.1994), printed publications of proper quality cannot be returned or exchanged.<\/p>\n\n\n\n If a book contains printing defects, the Seller will refund the cost of the defective item at the Buyer\u2019s request.<\/p>\n\n\n\n 3.1. If a manufacturing or transportation defect is identified, the Buyer may return or exchange the item within the manufacturer\u2019s warranty period or within 14 calendar days from discovering the defect.<\/p>\n\n\n\n 3.2. If the defect is confirmed, the Seller must:<\/p>\n\n\n\n 3.3. All costs for checking, exchanging, or returning defective items (including delivery) are covered by the Seller.<\/p>\n\n\n\n 3.4. International Orders: 4.1. To begin a return or exchange, the Buyer must contact the Seller:<\/p>\n\n\n\n 4.2. The request must include:<\/p>\n\n\n\n 4.3.
